Clarity on Title IX and to Whom It Would Apply.

Ok so with all of the recent discussion regarding the current problems surrounding the OSU football program, Title IX has been brought up on numerous occassions. I have seen comments on how Urban could be guilty of a Title IX violation and others strongly refuting this. So I downloaded the Title IX document from the DOE and here is what I found from section A titled scope of Title IX: "Title IX protects students, employees, applicants for admission and employment, and other persons from all forms of sexual discrimination...".

I always was under the impression the victim had to be a student or employee of said university, but the document appears to open it up to "other persons". Does anyone have any experience working with Title IX or have any insight into this section of the law and how it is applied? Specifically, could Courtney Smith fall into this other persons category? If not, who would the other persons be?
