OFFICIAL ELEVEN WARRIORS GIVEAWAY RULES
These Official Giveaway Rules apply to Eleven Warriors giveaways, sweepstakes, contests, and similar promotions (each, a "Promotion") unless the post, article, social media post, email, or other announcement for a specific Promotion (the "Promotion Post") states otherwise. By entering, attempting to enter, or otherwise participating in a Promotion, each entrant ("Entrant") agrees to be bound by these Official Giveaway Rules, the applicable Promotion Post, and the decisions of Eleven Warriors, LLC ("Sponsor"), which are final and binding in all matters relating to the Promotion.
- Promotion Post Controls Specific Details. Each Promotion Post will state the material details for that Promotion, which may include the prize, approximate retail value, number of winners, entry method, entry limit, start date, end date, time zone, winner selection method, winner notification method, response deadline, and any additional restrictions. If the Promotion Post and these Official Giveaway Rules conflict, the Promotion Post controls only as to the specific Promotion details stated in that post.
- No Purchase Necessary. No purchase, payment, or entry fee is necessary to enter or win. A purchase will not increase an Entrant's chances of winning. The Promotion is void where prohibited or restricted by law and is subject to all applicable federal, state, and local laws and regulations.
- Eligibility. The Promotion is open only to legal residents of the fifty (50) United States and District of Columbia who are eighteen (18) years of age or older at the time of entry and who can receive shipment at a valid U.S. mailing address, unless the Promotion Post expressly states a different age requirement and describes any parent or legal guardian consent required for entrants under eighteen (18). Employees, officers, directors, agents, and representatives of Sponsor, and their immediate family members or household members, are not eligible. "Immediate family members" means parents, step-parents, children, step-children, siblings, step-siblings, and spouses. "Household members" means people who share the same residence at least three (3) months a year.
- Promotion Period. The start and end dates, times, and applicable time zone for each Promotion will be stated in the Promotion Post (the "Promotion Period"). Sponsor's computer or designated platform clock will be the official timekeeping device for the Promotion. Entries submitted before or after the Promotion Period are void. Sponsor may postpone, extend, suspend, modify, or cancel a Promotion if fraud, technical failures, legal requirements, platform issues, or other causes beyond Sponsor's reasonable control affect the integrity or administration of the Promotion.
- How to Enter. Entrants must follow the entry instructions stated in the Promotion Post. Entry methods may include commenting on an Eleven Warriors post, submitting an entry on elevenwarriors.com, posting on a social media platform, using a required hashtag, answering a trivia question, or another method stated in the Promotion Post. Entries that are incomplete, late, misdirected, illegible, inaccessible, corrupted, automated, generated by script or bot, or otherwise not in compliance with these Official Giveaway Rules or the Promotion Post may be disqualified. All entries become the property of Sponsor and will not be returned.
- Entry Limits. Unless the Promotion Post states otherwise, entries are limited to one (1) entry per person and one (1) entry per household. Entrants may not use multiple accounts, identities, email addresses, or other methods to exceed the stated entry limit. Any Entrant who attempts to enter more than permitted may be disqualified.
- Winner Selection. The Promotion Post will state how winners will be selected. For random-drawing Promotions, winners will be selected at random from among all eligible entries received during the Promotion Period. For trivia or first-correct-answer Promotions, winners may be selected based on the first eligible correct response received, as determined by Sponsor in its sole discretion. For judged Promotions, the Promotion Post will state the applicable judging criteria. Odds of winning depend on the number of eligible entries received.
- Winner Notification. Potential winners will be notified using the method stated in the Promotion Post, which may include email, direct message, reply, comment, or another platform-based method. If a potential winner does not respond within the stated response period, cannot be contacted, is found to be ineligible, fails to provide requested verification, or otherwise fails to comply with these Official Giveaway Rules, Sponsor may disqualify that potential winner and select an alternate winner.
- Prizes. The prize or prizes for each Promotion will be stated in the Promotion Post. Prizes are awarded "as is" without warranty or guarantee, express or implied, by Sponsor. Prizes are non-transferable and may not be assigned, sold, auctioned, substituted, or redeemed for cash by the winner. Sponsor may substitute a prize or portion of a prize with another prize of equal or greater value if the advertised prize becomes unavailable or if Sponsor determines substitution is necessary.
- Shipping and Prize Fulfillment. Prizes will be shipped only to valid mailing addresses within the United States. Sponsor is not responsible for prizes that are lost, delayed, damaged, stolen, misdirected, returned as undeliverable, or otherwise not received after shipment. No substitute may claim, pick up, or receive a prize on behalf of a winner unless Sponsor expressly approves otherwise in writing.
- Taxes and Required Documentation. Winners are solely responsible for all applicable federal, state, and local taxes and any other costs or expenses associated with accepting or using a prize that are not expressly included in the Promotion Post. Sponsor may require a potential winner to complete and return an affidavit of eligibility, liability release, publicity release where lawful, tax form, or other documentation before awarding a prize. Sponsor may issue applicable tax forms when required by law. Where a prize's approximate retail value or the structure of a Promotion triggers state-specific registration, bonding, or filing requirements, Sponsor will complete any such requirements prior to the start of that Promotion, and the applicable Promotion Post may include additional eligibility restrictions or disclosures needed to comply with those requirements.
- Verification. Sponsor may require a potential winner to provide proof of identity, age, eligibility, and U.S. mailing address. All identification and verification materials are subject to review and acceptance by Sponsor in its sole discretion. Identification that is counterfeit, illegible, incomplete, tampered with, or otherwise altered may be rejected.
- Personal Information. Personal information collected in connection with a Promotion (such as name, email address, mailing address, or phone number) will be used by Sponsor to administer the Promotion, including winner selection, notification, and prize fulfillment, and otherwise handled in accordance with Sponsor's privacy policy, available at elevenwarriors.com.
- Content Standards. Entries must not contain material that Sponsor determines, in its sole discretion, is obscene, pornographic, explicit, hateful, threatening, harassing, defamatory, unlawful, infringing, misleading, or otherwise inappropriate. Sponsor may disqualify any entry or Entrant that violates these standards or otherwise fails to comply with these Official Giveaway Rules or the Promotion Post.
- Entrant Content and Rights. If a Promotion requires or permits submission of photos, videos, text, comments, or other content, each Entrant represents that the submitted content is original to the Entrant or that the Entrant has all rights necessary to submit it. Entrant is responsible for ensuring that submitted content does not violate any copyright, trademark, privacy, publicity, or other rights of any person or entity. By submitting content, Entrant grants Sponsor a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, display, distribute, edit, and share the content in connection with the Promotion, Sponsor's editorial coverage, and Sponsor's marketing and promotional activities.
- Publicity Release. Except where prohibited by law, acceptance of a prize constitutes permission for Sponsor to use the winner's name, username, likeness, city, state, prize information, and submitted content for promotional, advertising, editorial, and marketing purposes without additional compensation.
- Release and Limitation of Liability. By entering, Entrants agree to release, indemnify, and hold harmless Sponsor and its parent companies, subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, officers, directors, and employees from and against any claims, damages, losses, liabilities, costs, or expenses arising out of or relating to participation in the Promotion, acceptance or use of a prize, or any breach of these Official Giveaway Rules. Sponsor is not responsible for technical failures, platform outages, unauthorized human intervention, lost or unavailable network connections, failed communications, incomplete or delayed entries, or other errors or problems that may affect the administration, security, fairness, integrity, or proper conduct of the Promotion.
- Disputes. By entering, Entrants agree that any disputes, claims, or causes of action arising out of or connected with the Promotion or any prize awarded will be resolved individually and without resort to any form of class action. Any claims, judgments, and awards will be limited to actual out-of-pocket costs incurred, excluding attorneys' fees. Entrants waive the right to claim punitive, incidental, consequential, or other damages, and waive any right to have damages multiplied or otherwise increased.
- Governing Law and Venue. These Official Giveaway Rules and each Promotion are governed by, construed, and enforced in accordance with the laws of the State of Ohio, without regard to conflict-of-law principles. Any dispute, claim, or cause of action arising out of or relating to a Promotion or these Official Giveaway Rules will be brought exclusively in the state or federal courts located in Franklin County, Ohio, and each Entrant consents to the personal jurisdiction and venue of those courts.
- Severability. If any provision of these Official Giveaway Rules is held to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
- Platform and Third-Party Disclaimer. This Promotion is not sponsored, endorsed, administered by, or associated with Facebook, Instagram, X, Ohio State University, the NCAA, the Big Ten Conference, or any other third party unless expressly stated in the applicable Promotion Post. By entering, Entrants agree to comply with the terms and policies of the platform used to enter.
- Sponsor's Rights. Sponsor reserves the right to disqualify any Entrant who tampers with the entry process or operation of the Promotion, violates these Official Giveaway Rules, acts in an unsportsmanlike or disruptive manner, attempts to threaten or harass another person, or otherwise acts in a manner Sponsor determines to be unfair, inappropriate, or contrary to the spirit of the Promotion. Any attempt to deliberately damage any website, platform, or entry process or to undermine the legitimate operation of a Promotion may violate criminal and civil laws, and Sponsor reserves the right to seek damages to the fullest extent permitted by law.
- Sponsor. The Sponsor of the Promotion is Eleven Warriors, LLC, unless the Promotion Post identifies a different or additional sponsor.
