Ohio State's men's basketball team lost to Michigan in Columbus for the first time since 2003 on Tuesday night. This assumedly made Michigan coach John Beilein a very happy man.

Yet, Ohio State's pregame video, which included things like Evan Turner's 37-foot shot against Michigan in the 2010 Big Ten tournament quarterfinals, also included clips of Ohio University's upset win over Michigan in the 2012 NCAA tournament and Chris Webber's infamous time-out call in the 1993 national title game.

Sure, it might have been childish, but it was a complete troll move.

Consider John Beilein trolled. From MLive.com:

"I hope Michigan never does that," Beilein said. "I don’t want to ever do things like that."

The video wrapped up with an unflattering picture of a Michigan fan, followed by the words, "Pure Michigan," a nod to the state's tourism slogan. 

"There’s a lot of great things in this rivalry, I don’t think that’s one of them," Beilein said. "We’re not going to do that a long as I’m here."

I wish Beilein had never said a word about this.  Unfortunately, he was asked about it.  I think he was asked about it more than once.

For the record, I wish I had been in the Schott for this.  Of all of the crazy shit in collegiate athletics these days, the OSU pregame video counts as barely worth mentioning, and then only with generous laughter.  I am immediately going back to award a helmet sticker to whoever mentioned the "Go Blue" skywriting in East Lansing.  I am one of many who cannot imagine what Brandon (or other assistant AD) was thinking.  Couldn't the skywriting have been, "Surrender Dorothy"?  Or better yet, "Surrender Dantonio."  I mean, you gotta make an effort at clever at least.

I hope Beilein is completely wrong.  I hope Michigan is not above this sort of funny stuff.  I hope the Michigan video for OSU's return to Crisler has our own version, which will now include  Aaron Craft's posing follow-through on his final airball.

I think the question is "what did he know, and when?" For example, did he know on say the 20th and play the kid on the 22nd? Did he make up some story about an injury to cover for him? Man if only these questions could be answered, but it seems that the one source that is actually asking questions has been blocked from pressers. "Know" what?  That a "conflict resolution" panel was accusing him of something?  The incident with Gibbons occurred when Hoke was still the coach at San Diego State.  In all of the years since, the police had not referred charges, the prosecutor had not brought a charge in court, and the university had not taken any other action.  Hoke, I presume, knew all of that.

Did he make up some story about an injury to cover for him? 

I don't know the answer to that.  There seems to be good reason to suspect so.  But I ask, given the underlying matter -- not an arrest, not a prosecution, but a legally-confidential proceeding in which Gibbons' basic rights were not likely to be protected -- was Hoke empowered to say?.  By law, I don't think that Hoke could make any specification about Gibbons in that case.

I've gone on the record saying that I do not like the idea of Hoke saying anything affirmatively that misleads.  Better to have said nothing at all.  Some Michigan fans defend Hoke by saying that it is all part of the game; a coach not making any public announcements that will help opponents game-plan or to cause the coach's own team any distractions.  I don't accept that view myself.

Man if only these questions could be answered, but it seems that the one source that is actually asking questions has been blocked from pressers.

That turns out to be wrong.  There was a prearranged event at which a few of the local writers had asked for access to Hoke.  There was no "press conference," and no "ban" on the student newspaper (which is The Michigan Daily, which broke the story with illegally-obtained documents from the OSCR hearing).

Michigan associate athletic director Dave Ablauf said the Monday session with Hoke was not meant to exclude anyone. The Associated Press was not present, nor was ESPN and the Toledo Blade, which regularly cover the team, and there were no television outlets included

“We did not hold a press conference (Monday),” Ablauf said Tuesday. “Five reporters requested to meet with Brady to discuss football topics, so we arranged this meeting about three weeks ago and set the meeting day and time over a week ago (prior to publication of the Daily story about Gibbons).”

In these kinds of cases, there is a legal and moral imperative to protect the identity and even the existence of the accuser.  Nobody doubts that.  If this matter had been in a court of law, where it should have been -- or not been, as the case may be -- Gibbons' name would not be protected.  But since it was in front of the "student conflict resolution" board, BOTH students deserved protection.  The Michigan Daily, however, went ahead and published Gibbons' name in the face of rules for the rest of the University that would have strictly prohibited publication.  The Daily did it on the basis of being given a leaked document.  An illegally-leaked document, it would seem.  I don't expect that The Daily will face any punishment or legal jeopardy, though the leaker, in my opinion, certainly should.  Hoke was pretty clearly trying to protect Brendan Gibbons under circumstances where legally (with just about all of his other rights diminished) Gibbons was owed at least some protection.

That's a great question, and a fair one.

Gibbons was expelled by a university "Office of Student Conflict Resolution" committee.  It is a committee composed of unknown people, none of whom are any sort of judicial officer.  I suspect that the panelists may be social workers, conflict resolution counselors, rape counselors, etc.  No one's substantive and procedural due process rights are protected in any meaningful sense (although the University pays lip service to it).

We know what is in the few police records that have been redacted and posted online following a FOIA.  The incident occurred in November of 2009.  Those records seem to generally indicate that both students had been drinking, and the accuser may have been drunk.  There is at least some indication that the accuser performed oral sex.  There is indication that she claimed that intercourse was not something she consented to; Gibbons says she was into it.  For his part, Gibbons consented to questioning by the police and answered questions without demanding counsel.  There is more, of course; but in the end the Ann Arbor police (who have never in my memory over the last 20 years ever been accused of covering up anything for any Michigan football player) wouldn't even refer a charge to the Washtenaw County Prosecutor's office.

Now, to your question.  Having noted just how far away from any prosecution for "rape" (the charge would be "criminal sexual assault" in Michigan) this was, and having noted that Gibbons was hauled before a student conflict resolution committee four years after the fact and after having done nothing wrong in the interim, we can come back to what it is the OSCR does.  By its own terms, the OSCR doesn't do prosecutions.  They say up front that they are not a court -- criminal or civil -- and don't operate as such.  What they do is enforce a climate on campus.  The desired climate is one that is free from an atmosphere of sexual harassment.  They set the bar very low; they don't feel the need to prove crimes, they are strictly concerned with an academic climate free of harassment, and the standard of proof is an unconscionably low (at least for any notion of criminal guilt) "preponderance of the evidence."

I say this to you with the absolute utmost seriousness and respect; Ohio State is merely one unfortunate night, involving just one of your many star athletes, from dealing with this.  It doesn't even need to be an athlete.  There is an amazing brave new world at all campuses under Title IX, since an April, 2011 directive from the Department of Education Office of Civil Rights.

Start your reading with this column by James Taranto in the Wall Street Journal.  It concerns an infamous non-athlete case at Auburn.

Taranto has followed up with this very recent online column, dealing with the issue of two-party drunkenness in such cases.

I thank you, Poison Nuts, for your question and I hope I can help you figure this out.  I'd love to know more about exactly why Gibbons was expelled.  We can't see the record of the proceedings, unless somebody leaks it.  We know that there was nothing normal about Gibbons' case.  Gibbons was the subject of a yearlong campaign against him by a local gadfly blogger, who has made a second career out of going after supposed university scandals.  Football scandals are his favorite beat.  Gibbons' four-years-later hearing was unprecedented as far as I know.  The University of Michigan has said in no uncertain terms that they felt prompted to act by virtue of the Washington-based (2011) changes in Title IX enforcement.  I'm not aware of any other expulsions, under any similar circumstances.  There is massive concern over who leaked the news (protected by law) of the student disciplinary proceedings.  The story is not over.  But in no way, shape or form can anyone with a brain claim that there had been any "coverup," because it has been known since 2009, and the police fully investigated it at the time.

Rape is only covered up at Notre Dame!  I do think we should all pump the brakes on drilling anyone over these accusations when they pop up at other schools though.  It was pretty recent that we had such an accusation here.

Just curious about something - are the BBall hype videos assembled by the student video dept, or does the Bball team have it's own video dept like the football team? Just curious if anyone knows how that works. Personally, I like that they are inflammatory like this recent one & the "deal with it" one...although this time it didn't really work out too well. Ohio St fans may not like to refer to TSUN by it's school name, but we certainly don't call it the name of another University.  To me, this is disrespectful to Ohio University, and just unbelievably ironic considering that they actually lost to OU in the NCAA's a few years ago.  You would have thought that it would have deterred them from referring to us as "Ohio" moving forward, but they must have blocked that loss out from their memory banks.

I wanted us to win so badly the other night, and then for the crowd to start a, "say my name bitch" chant.

Beilein needs to stop being such a whiny bitch and focus on winning games and his program.  When he stops the pettiness of calling us "Ohio" maybe we will stop showing him videos to remind him that we are actually not in-fact Ohio.

I just love this rivalry - the jabs the two schools and fanbases take at each other are awesome and make me laugh!  There is nothing quite like the look you get (and give) when you pass somebody wearing your school's threads!  When I first moved to Toronto I went to the St. Lawrence Market to get some excellent local goodies and what do I see... some dude sporting a Michigan hoodie.  We just started laughing!

Michigan better step their game up in football, right now Michigan State is Ohio State's rival in the state up north. Michigan is the new Notre Dame. 

I've spent time in the South, I don't care what anybody says they don't have the passion for football that us Ohioans have.

I read somewhere that what really ticked him off was that our video was on a Betamax cassette.  Beilein then had to drive home to get his Betamax player to watch the video, and it was buried under all his 8 track tapes.
