Doesn't seem to be anything groundbreaking here but the handwritten note is interesting, particularly the part where it says "what would we do if this was a player?" "Entitled to due process". Think that pretty clearly sums up OSU's mindset about 2015.

HS
BrutusB's picture

I noticed that too. Considering that Hyde was initially dismissed (during investigation), then suspended for three games (for not following core values), it seems they didn’t quite follow that analogy to conclusion.

Hyde was on camera getting in a woman’s face & then swatting at her (yes, in retaliation). It wasn’t he said she said.

Some one, Courtney, McMurphy, some young snot at ESPN will find some bullshit nugget in these docs and make a mountain out of a mole hill.  Counting down the hours until this eventually happens.

Urban is a good coach, ethical coach, hardass and overall great for Ohio State.  Someone wants his ass fired and will stop at nothing until it happens.

Sure.. minus the reference to "all of these domestic violence issues" which seems to I dicate the author of the email has a particular perspective on the allegations and possibly an agenda. We can all appreciate that Zach Smith should have been let go much sooner... But I still don't believe all of his other issues are necessarily/if at all, related to the domestic violence allegations. It seems like his issues are being used to try and give more credibility to the allegations, which is what I would estimate was the true purpose of that email.

HS

I will even accept that he may have been overly physical at times... But I haven't seen enough to flat out say he was abusive or even that he assaulted her, and it does eem like that would be difficult to hide that stuff given the extensive police and university awareness and involvement.

Yeah, that was a bit odd.  I'm far from a HIPAA expert.  But releasing the treatment plan and patient identity for a facility at which you work is a bold move.  I certainly wouldn't do so without a pretty educated opinion on the subject.

I had the same thought.  I wonder about the proper intersection of HIPAA and public records laws.  Again, I'm far from a HIPAA expert, but I don't see how that e-mail isn't a violation.  And I suspect that public records law would yield to HIPAA's policy considerations.

HS
vtbuckeye's picture

Not only does this appear to be a HIPPA violation (up to 10k fine per occurrence if inadvertent ), but this is a willful violation 100k per occurrence. I would certainly be fired for publicly publishing a specific patient's treatment plan (I work in pharmacy).

HS
Buck61's picture

I wonder what the usual protocol is in regards to this matter. I would assume someone from the facility would contact the Medical Director or some point of contact in the office and inform them that he failed to compete the first portion of the program.

Once someone in the Medical Director's office knew of this, then what is the normal procedure? If it was a mandated, in many cases he could have been fired for not completing the program.

I am seeing no new or "damning" evidence against Urban Meyer.  In fact, I am just seeing a report that is guiding Smith to not talk to his ex wife.  Further, I am seeing a "restraining order" or a no contact order that can be obtained by anyone in or after a divorce.  I am still having a hard time believing that any of this means that Urban Meyer's name should have been drug through the mud.  Regardless, glad the FACTS are out.

In the willishandwritten note pdf; on page 3 it reads like OSU tried to contact Courtney Smith!? It was confusing and hard to read, but did anyone else see that?

HS
Gmac44135's picture

I saw it and it confused me as well. I wanted to wait until another poster explained that section of articles. I remember though that the media was grilling Urban Meter and Ohio State for not contacting Courtney Smith which I felt was a little absurd.

HS
Bringer of JUICE's picture

Well and that is Courtney's big claim in her Stadium interview.  OSU never contacted me.  I hope we can get some clarification on that section.

HS
LoufromOSU's picture

Tough to read, but I think the confusion is coming from her using "C.S." - everyone  is now used to that being Courtney Smith, but in this document, it was referring to Chief Craig Stone of the Campus police.  Chief Stone said that a "reporter OSU tried to interview the wife" before stating there was an open records request from the media (OSU beat reporter?).

BTW, that was the notes of Meichelle WIllis, the deputy title IX coordinator and head of compliance for athletics, whom Urban and Gene would have had to report to.

The university is legally obligated to provide these since multiple media members have filed FOIA requests. I would rather read them myself and come up with my own takeaways then have ESPN do it and spoon feed me the narrative they want to push. If you don't want to pay attention that's fine but the media will cover this regardless. I'd rather make sure both sides are out there.

That anonymous email is a huge HIPPA violation. It should have not been made public. Not a fan of ZS, but he has grounds for a lawsuit against the facility.

HS
Dstacify's picture

Yep. I work in the healthcare field and that is a HIPPA violation down to the T regardless of the reasoning for forwarding that information. The only way I would think the facility isn't liable for a lawsuit there is if they obtained express permission from ZS himself to share the e-mail and it doesn't expressly say here that they did.

11 Strong.

HS
vtbuckeye's picture

And not just the incidental violation. This is a willful violation of the very expressive variety... Unless ZS said that it is OK...In writing. Doesn't the university have lawyers? Don't they have a hospital that knows how to follow HIPPA laws?

HS
Dstacify's picture

Not to mention isn't Drake himself a doctor? He of all people should understand what HIPPA violations are and how serious they can be. If he condoned this without ZS's express permission and exposed the school medical facilities to HIPPA lawsuits as a result that's just plain negligent and careless on his part. But again I also don't know how directly involved Drake was in the investigation (from what it sounds like, not very much involved at all).

Holy cow, Zach Smith, while I do not believe he abused Courtney Smith, is a first-rate, top of the heap fuck up. Immature, unprofessional, addle-brained moron. Meyer knowing this, and still repeatedly allowing him the privilege and honor to continue on as an Ohio State football coach is unfathomable. I simply do not think Meyer is a guy who would knowingly allow and/or cover up an abusive situation, and I think he knows that Courtney Smith is crazy and lacks credibility... but aside from all the Courtney allegations, the way Meyer mismanaged Zach Smith and bungled the presser in Chicago is incomprehensible for a guy so accomplished.

When I die, sprinkle my ashes over the 70's

HS
Defiance's picture

I have to preface this next part by stating I absolutely support UFM as the head coach of The Ohio State Buckeyes but this...

the way Meyer mismanaged Zach Smith and bungled the presser in Chicago is incomprehensible for a guy so accomplished.

speaks volumes Kmp10!!

1) The fact that ZS was ever on staff at tOSU is a head scratcher and the only explanation albeit it illogical is Earl Bruce. Heart>head.

2) The fact that UFM did not disclose any of ZS's previous run-ins when he was being vetted by tOSU for hire is unforgivable.

3) The fact that UFM still kept him on staff even after GS suggested he move on from him is just digging a deeper hole.

4) UFM and his ramblings at the B1G Media days is so un-Urban like. He's generally well spoken and to the point but that day the wheels just seemed to come off.

5) His ego got in the way of his mouth and took over from there. He talks about "There being nothing, once again there was nothing. Who creates a story like that?" He talks about pressing pause and getting your mind right and step up and the whole E+R=O. Press pause again and get your mind right. Step up, pause your mind and collect information and step up and do the right thing.

It's not word for word but it just seems like he'd have been better off using the no comment and the situation is still fluid and when the time is right, we'll discuss it further. I get that all of this is hindsight but I just feel (like many of us on here) that UFM, Gene Smith, Michael Drake and the entire university just seemed to fumble this whole damn thing time and time and again and they continue to say and do all the wrong things.

Rant over. Open for discussion and agreement/disagreement.

I think it is clear that ZS's bloodlines definitely kept him employed, but he was also (and I hate to give this shitbag any credit) a really good recruiter.

And from what I've seen with college position coaches, it doesn't really matter if you can coach the position all that well as long as you can recruit at a high level. I truly believe if he was just a shitty coach and shitty person that Urban wouldn't have kept him around, but he was a really good recruiter.

The hand written note talks about due process. They did this with Hyde and Storm Klein did they not?

HS
NGBuck21's picture

They dismissed Storm and then brought him back. He plead guilty to disorderly conduct. Now granted, they were not shown to be universally incompetent as Zach Smith has shown to be over and over. The card situation, missing  appointments, never showing up to recruiting assignments was well worthy enough for a suspension of Meyer in my opinion.

As other have mentioned, we can move on as can Meyer and the program. He made a mistake by giving someone too many chances. It happens. He is gone now and everyone should let the Smith situation be handled by those families and the court system now.

I know that "respect women" is a core values. I know that punching/hitting a woman is not respecting a woman, but come on is that the only way to disrespect a woman? I fail to see how ZS was not disrespecting CS, though she wasn't so respectful herself. If it is a core value it should apply to athletes and coaches. How ZS still had a job at tOSU 3 months ago is beyond conceivable if they really followed their core values.

I don't really think Paul and Brett well maybe just Paul will ever give up on UM. I think he has something personal against UM as in jealous of the man's job his life etc. Paul's a loser. And I agree Drake needs to go ASAP. in the meantime maybe he can stop watching cable and delete his ESPN app on his phone.

Finebaum's an SEC guy and Urban walked out on what was once the SEC's flagship program when he was coaching there. Finebaum will always hold a grudge against Meyer for that reason alone since the SEC was a stronger conference overall back when Florida and LSU were good. Now they're just a top heavy conference with Bama, Georgia, and Auburn being good and all the other teams being just meh. Plus he hates the B1G in general. He spent most of last season going off the rails against Harbaugh.

The “anonymous friend” dishing details about Zach’s stint in rehab can only be one of three people:  Courtney Smith, Julia Leveridge, or Brett McMurphy.  Given the lousy grammar and spelling on display, I’m going to guess Option 1 (unless they’re going all-out to protect their identity).  The email was sent to David Sarratt, one of Mary Jo White’s attorneys working as an investigator here.  No anonymous tipster from the outside of this situation is going to know who David Sarratt is, nor would they have his email address.  Furthermore, the same information in this email was tweeted out by McMurphy on 8/22, before OSU had ever released any of these documents to the public.  This was Courtney using a sock puppet, much like she’s doing on Twitter right now to leak dirt on both her mother and Lynn Bruce.

EDIT:  I guess it could also be our favorite QAnon theorist OSUSmitty or his ex-wife.  Forgive me if I wish to forget about them.
