Fear, or a realization that doing so would have significant financial implications. Smith losing his 6-figure job would have meant significantly less child support or alimony. If she had legal counsel, I'm certain they would have brought that to her attention.

I do not have any reason to doubt her claims, but all that was apparently known by Urban is that she was claiming Smith abused her, and Smith was claiming she was lying to hurt him.  She-said/He-said.  Lacking actual charges being pressed, photographic evidence, or 3rd party corroboration, what exactly are you obligated to do?  And did Urban do that?

Show me CHARGES FILED, PROSECUTED, FOUND GUILTY.

And then after that, show me where Urban knew about it and lied about it to cover it up. Then and only then will I pass judgement that Urban has done wrong here and deserves termination.

Courtney Smith also told McMurphy that in 2009, when Zach was arrested for allegedly assaulting Courtney in Gainesville, Florida, that she was pressured not to press charges by former Ohio State head coach Earle Bruce – Zach's grandfather – and Hiram de Fries, a close friend of Meyer who holds the title of special assistant to the head coach at Ohio State.

On a July morning in 2009, Courtney Smith sat across the table from de Fries, a former attorney and Shell Oil executive. Courtney said de Fries pressured her to drop the charges.

“He said ‘if you don’t drop the charges, Zach will never coach again,’ ” Courtney said. “ ‘He’s never hit you before. He was drinking. He’ll probably never do it again. You should think about giving him a second chance.’ “

Ultimately, Courtney said she relented to de Fries and didn’t press charges. Courtney had convinced herself this would never happen again.

She was wrong.

The report from The Dispatch states that Courtney kept the court documents sealed in order to “to protect certain personal interests which, if published, may negatively affect (Zach Smith’s) occupation, the parties’ financial circumstances and the children’s well-being.”

She was afraid to press charges because she didn't want to negatively affect her ex-husband's ability to take care of their kids, in a financial sense. This is a very real concern in cases like this, and when making the decision to get out of an abusive relationship. I suggest you do some research on the topic.

Not only did she not press charges, she took active measures to ensure that no one knew about the abuse so Zach could keep his job. To anyone claiming there's a coverup, your witch hunt starts here. She made the decision to seal the documents and keep people whose job it is to help from intervening. Anyone blaming a football coach or employer is insane.

We know someone who is in a similar position. Because of fear of losing alimony and child support the victim doesn’t want to damage the money maker and thus damage herself. Now I don’t know this about the smiths of course, but I’m just saying I’ve seen this elsewhere. Because of the criminal nature oyr friend’s husband’s behavior, his income would go away. It’s keeping this slimy bastard  lout of possible jail time and surely a firing. It’s a frustrating catch 22.

i think one thing that has become clear is that nobody wanted to see Zach fired for reasons of financial hardship on the victim and her children...... it seems everything was kept under raps (even by courtney and at the request of her own family) so that they did not lose their revenue stream. now that meyer and osu finally did what probably should have been done years ago, fire his ass, they are getting raked over the coals for it.

I was under the understanding and Im pretty sure if there are SIGNS of physical abuse that it doesnt matter what the victim wants to do, the abuser will be placed under arrest. There are now pictures of Courtney with red bruises on her. Unless the PD never saw these pics its hard to understand why Zach was never arrested.

I know that's the case here in NJ (no, not from personal experience). Even then, once the alleged abuser has been arrested and removed from the premises, the (alleged) abusee can still decide not to cooperate and the case gets dismissed (as with 80% of the cases here in NJ according to an article from last year),  Not sure of the law in Ohio, or what the stats are.

I think it was less about Earle's legacy. More likely they didn't want a old dying man to find out something so bad so near to death.  But that doesn't make it OK. But this stuff is now coming out AFTER coach Bruce died.

Oh, I understand that.  But there's a difference between PR and liability.  Liability means that you caused something to happen, or were responsible for it happening.  Whatever happened between the Smiths, it happened off the field.  Whether Smith worked for OSU or not has no bearing on whether he assaulted his wife.  Those are two different issues.

The Title IX issue that employees of the University must report any kind of sexual abuse or harassment or any violence associated to the university. Both Urban and Shelley are employees.  For me, this is the biggest potential issue.

sorry, been on vacation.  I am just saying, as a 40-year vet of the commercial insurance business, I don't see that the University would be held liable for anything that's happened so far...

If there was a suit to be filed, even one based on a dubious theory of negligence on tOSU's part, some attorney would have filed it for CS, for the publicity alone. 

I will get caught up on the news, but I have not heard of any litigation yet. 

Certainly, I could be wrong.  I've learned that over 40 years as well!  :-)

Yep.   All Meyer had to say was "we knew about allegations in 2015 but when they failed to lead to any charges being filed, we decided to keep Smith on staff."   I mean, in hindsight it looks like we didn't do enough, but that's way better than what we have now.

Not sure if this is in response to me. If so, kids= kids of Zach and Courtney Smith. They are absolutely the real victims. They have done nothing to deserve what is going on right now and this will impact them for the rest of their life.

Interesting, I am not aware of research regarding this topic, but I am interested to find out why the parents of an abuse victim may not report it. Maybe some of the reasons the victim does not report it, e.g. financial consequences, embarrassment, they do not believe it is abuse, etc.

This indicates it was Courtney who kept the documents sealed to protect her own source of income. If that's the case, that's pretty liberating for any type of responsibility Urban might have had in my mind. It at the least indicates that Courtney herself was willing to hide information to protect Zach's job. It's still hard to believe Urban didn't know after the communication between Courtney and Shelley, but maybe he had reason to doubt Courtney and trust Zach when official records were kept under wrap.

Text messages from an ex wife to the wife of the ex-husband’s employer are not proof of anything, and I’d hate to think they could get someone fired.  Absent official action from the police all I can see Urban doing would be taking Zach aside and yelling at him to get his shit together, not giving him raises along with the rest of the staff and encouraging him to look for work elsewhere.

There's no dates on those text messages.  They could be from after the trespassing violation.  Shelley clearing asked in one of the text "Didn't law enforcement come to your place ever?" and "You should get a restraining order".   On July 20, 2018 Zach was served with a domestic violence civil protection order.

Agreed. I wanted for more info to come out before forming an opinion. You have her calling 911 on all these instances and not one report claims or shows physical abuse. So either the cops seen nothing to report or they are terrible cops. 

Sadly too many people already formed an opinion hours ago. I still think Zach is a POS and bad person. But really question all she is alleging.

But the public is no pushover. A woman says she was repeatedly pushed against walls and repeatedly strangled, all while the alleged perpetrator remained on Meyer’s payroll facing zero disciplinary action.

Meyer needs to be held accountable for that.

She can say he didn’t face disciplinary action all she wants but the fact is she doesn’t know.  Smith was the only member of the coaching staff not to get a raise in salary AFAIK, and who knows what else.  Aside from that she can’t expect Meyer to fire Smith without any official police action or charges, just based on accusations.  I believe Smith is an ass, but what can Meyer do aside from make it uncomfortable for Smith and encourage him to leave, which I understand he had been doing.

While it could look like this is a smear campaign orchestrated by Courtney, that poor woman has been locked in a position of oppression for years. I do not blame her for feeling vindictive now that she finally has some feeling of empowerment for the first time in a long time.

As far as Urban goes, its most likely he knew about her allegations, but theres too much unknown to cast judgement on him and tOSU and this point. That, and we certainly could still be waiting for the dust to settle on this one. More information could come out, positive or negative. So its too premature to know exactly what he was aware of or understood was going on in the Smith household.

And we haven't heard anything from Zach as of yet. EVERY story has 2 tales, regardless of who the protagonist is. He may be an abuser and an absolute asshole, but he may not be guilty of everything thats cast on him.

Who knows. I just want this damn offseason to end

I can't stand Miami but one thing they did do - when they were being accused a few years ago - they told the ncaa to go pound sand - they were not accepting anymore sanctions. I always thought that should have been our response on Tressel. Right now I'd have OSU say:

"We have a statement. Our statement is that we will have another statement when we have a statement to make. In the meantime, go back to doing what you do best - making up $hit and jumping to conclusions because it fits your preconceived narrative. And BTW, pound sand while you are at it."

Where is the actual evidence?  Did she provide the hidden cameras to law enforcement?  Did anyone trace this black SUV to an owner?  Still waiting for an actual picture of these supposed texts.  Still waiting for copies of their phone bills showing the calls made and the texts sent with date/time/phone number contacted.  It may all be true but seriously so far it is all her saying these things and it is right after he got fired which also means there is no more money coming in.  Cannot pay alimony or child support when the income stream stops.

As for the items mentioned at the very top of the story you can just as easily have someone who is just paranoid thinking they are being followed.  Would not surprise me at all that it was true but still, lets get some hard evidence.

The report from The Dispatch states that Courtney kept the court documents sealed in order to “to protect certain personal interests which, if published, may negatively affect (Zach Smith’s) occupation, the parties’ financial circumstances and the children’s well-being.”

In other words, she didn't want him to get fired and lose his income which would result in a significant decrease in alimony/child support.

EDIT: I see now I misread your comment. I thought you asked when/why they were "sealed". You said "unsealed". My bad. And it's a good question.

If I remember correctly didn’t Urban deny knowledge of an arrest in 2015?  I thought that was all that he denied knowledge of...he didn’t deny knowing there were issues did he?  And one can’t blame him for not knowing about an arrest that resulting in removal of the accused name from the record and no charges being filed. McMurphy even acknowledged on the radio today that “techincially” Smith was never arrested in Ohio and that he has never been charged. So, I believe whole heartedly that Urban didn’t know about the exact 2015 incident in question. I also believe that Courtney Smith kept court documents SEALED in order to protect her income stream thus enabling her ex husband to stay employed and now she wishes to blast the university for allowing him to keep working?  I believe the Meyers, both Shelley and Urban were doing what they could to help the individuals involved and keep the family names out of the media and try to prevent a media feeding frenzy this protecting innocent children etc.  To say Urban lied and covered this up for football is just calling the man and his wife both horrible human beings. There’s more to this. I think once it hit the public eye and he lost his job good ole Zach got a message to Courtney somehow and she said- forget this- I’ll show you, and one reporter desperate for a job is all it took to blow it all up.

Umm, nope.  Has anyone proved or can anyone prove the validity of those txts?  Did you see one to the coach or from the coach acknowledging that she was being abused?  The sealed documents are  enough to prove Urban isn't lying.  I saw a txt saying that Urban asked Smith what was going on and he denied it.   was Urban supposed to hire a private eye  to see if Smith was lying?  With all reports being sealed and no arrests in 2015, Urban only had Zach as a resource and that's all he could do.  That's what I got from the dispatch.  .

Those texts have McMurphy's name on them. His story is all about him landing a job, not about Mrs Smith and what she had to endure at the hands of an asshole.  He simply failed with breaking this story.  YaPoo or bleacher report will probably hire him though.

The report from The Dispatch states that Courtney kept the court documents sealed in order to “to protect certain personal interests which, if published, may negatively affect (Zach Smith’s) occupation, the parties’ financial circumstances and the children’s well-being.”

Guess what has bigger pockets than Zach Smith, The Ohio State University.

She sealed the record to hide the evidence and then claimed the university and Urban Meyer knew about it the whole time.  If she would’ve let the reports go public Urban could’ve fired him for cause a long time ago.  Unbelievable...

Bradley Koffel, who is Zach Smith’s current attorney, said that his client kept Meyer in the dark about his legal brushes. Smith was charged with misdemeanor criminal trespassing in May after he dropped off the couple’s son at Courtney’s home instead of at a different site when he couldn’t reach his ex-wife.

A Powell police officer told Zach Smith five months earlier that he could no longer go to Courtney’s home to drop off their two children, but the Smiths’ shared parenting plan allows for him to do so.

“I can tell you as a matter of fact,” Koffel texted The Dispatch on Wednesday, “that Zach never told Coach Meyer about the 2018 criminal trespass even after I told Zach, ‘Urban shouldn’t have to hear about this in the news someday.’

“I now understand why Zach compartmentalized the info — to protect Urban. You cannot impute every family argument involving an employee and his wife to the CEO of a company or the head coach of a large football program.

“Also, when the police show up and walk away after investigating the accusations, that also factors into what action, if any, an employer should take against their employee.”

Columbus attorney Larry James, who represented Zach Smith in the 2015 matter, said that he did not share details of the allegation with Meyer or other OSU officials. He said that it would have been a breach of attorney-client privilege to do so.

“Do I have any reason to believe that the university or coach would have known of that situation? The answer is no,” James said.

He said he reached out to the prosecutor and investigating officer “and there was nothing there — unequivocal.”

I can believe Courtney did not press charges. I can almost bet she still is not sure how she feels about the situation. I watched my mother be abused for years by my father. She did not leave him until all of the children were out of the house. Years after she left him, we had a serious discussion about the environment in our toxic household. She told me he had her convinced "he was the best thing she would ever find",  "No one else will want you." He abused her mentally, physically, emotionally and sexually. He was a master manipulator. She healed, we all did, even him eventually.  Her family is enabling him, I bet there was abuse somewhere there passed along. I bet ZS saw abuse as a child somewhere. You learn it somewhere. We don't naturally treat people like that. The greatest thing about being human is you can recognize you need to change, and you can do it. Sometimes life has to really slap you hard to get you to recognize change is needed, this might be enough for all parties. If you need help making changes get it from a counselor or a member of clergy, but get it. Break the cycle, make the change you need to be a better man.

I have no reason to doubt that Courtney is a victim. ZS is a Probably a criminal straight up bad guy.  Zs is stupid at the least, but now that his money making days are through(until he runs for office) Courtney is suddenly on camera talking to anyone who’ll listen. Instead of focusing her anger at the criminal who repeatedly abused her, she is going after anyone near him. While she’s going public she needs to explain her decisions honestly about not pressing charges and thus getting a dangerous guy locked up. Some victims are so scared that they don’t press charges. I totally get that.  But coming after the coaches and their wives is a sudden coincidence that makes her look motivated, not victimized. She should clear up Her intentions while she’s slinging heresay mud nationally.

There is no proof Zach did what his ex-wife claims. Stalking? Cameras in her home? Repeated beatings? Banging on her windows? She's followed by a black SUV? No evidence other than her version of events... see The Duluth Model as why she received the restraining order. This is for family court, where allegations are considered true until proven false. Now, she can show her multiple police reports, a violated restraining order, and Zach's termination as proof she's telling the truth... in family court.

I think she was abused. I think that is simply terrible. But it appears she wants more money out of this. She may be right. But if she is using that to take someone else down that really had nothing to do with it, then that isn't good either. Two wrongs don't make a right. That may not be the case and simply the media is now running with this and now she is doing interviews.  I don't see how doing a televised interview helps her or her children in any way other than money.  I just don't like any part of this. It could easily bring Urban down, and she is helping that.  Did she really not want her husband to get that job back in '09?  What was her exit strategy?  Over that long period of time she had to have figured it was a good time to bail while Zach was out recruiting.  I guarantee leaving would be incredibly hard for anyone. But this happened over many years with Zach being gone so many times. I'm not blaming her for anything other than trying to make Meyer the fall guy. He fired Zach anyway.  Should have done it sooner ,but any human can see that this is a tough one on so many levels for him.  This one hit home on someone he really admired and it seems Zach's wife's uncertainty didn't help.

If, Zach did half of this stuff, then he is a real can of dogshit.  Its hard to know for sure up until this recent stuff, which gets really bizarre and why its all coming out now. The other stuff....I can see why Meyer wasn't totally positive and hesitated. She did too.

I’ve been through similar circumstances with a vindictive ex wife that really F’d my world up with false accusations and flat out lies to LE. It took me 6 years to recover and get full custody of my kids. She’s no longer in the picture or the kids lives. The damage that can be done is irreversible. 

I’m not saying this woman isn’t telling the truth but until facts are proven judgment shouldn’t be made on Smith and certainly shouldn’t be made on the university or Meyer. This whole scenario is just rotten and the wolves are coming. It’s gonna get ugly and all participants will suffer.

IMO the university has to do this just to show a reaction to serious allegations, regardless of the truth.

If Urban were put on trial by jury, he would be acquitted. He has a demonstrated track record at Ohio State of being inclusive of women and not tolerating any abuse of women. The women's football clinics. The suspension of Carlos Hyde. The near-suspension of Storm Klein.

He has a loving wife and two loving daughters. I find it hard to believe that he would ignore anything related to this.

In any case, I'm concerned that the university will cut ties even if Urban is innocent, just because of the 24x7 media nonsense.

A report from Oct. 21, 2015 indicates Courtney informed police that she felt she was being followed by someone in a black SUV, and shared she was having issues “with her soon to be ex-husband.”

Felt like you were being followed? So the f-what. Non issue, and frankly and don't see how that is any sort of headline here. 

Another report from Oct. 26, 2015 details Courtney Smith telling Powell police she wished to file a restraining order against her husband.

Did she? What cause?

There’s a report from January 5, 2016 in which Courtney Smith was given a speeding warning. Smith shared that she was having domestic issues with her ex-husband that day, and that the City of Powell was aware of it.

So they knew she was speeding and had a lame excuse for reckless behavior?

I will condemn when there is evidence.

 

She said she pictures to Shelly Meyer. Easy. Lets see them. I edited this, and pulled a picture I pasted of Nicole Brown Simpson, a victim of violence.

i agree that two of those bullet are huge nothingburgers:

-it is far more likely that smith had a PI on his soon-to-be ex-wife for ammunition in divorce proceedings than that he was tailing her two days before a game. this is a common and benign move for anyone with money to protect.

-crying to get out of a speeding ticket is as old as the automobile. to me, this is more damaging to courtney than zach, as has little credibility and evinces an opportunism and a familiarity in playing her victimhood into sympathy.

as for the rest, it seems credible he's a pretty shitty guy.

Why couldn't Smith's wife go and tell Urban directly all that Smith (allegedly) did to her if she expected him to be domestic counselor? Did she want Smith fired in 2015 or did she not? If she did all she had to do was file charges with the police and Smith would have been canned instantly.  I don't understand this woman's reasoning to wanting to lash out at Urban now for something that truly doesn't involve him at all.

In all those reports, I see nothing reported as domestic violence. As an ex law enforcement officer, if a person reports to the police of domestic violence it doesn’t matter if the so called victim files charges or not, by law the State has to pick up those charges. So, if no charges were filed or better yet, if nobody was prosecuted then in the eyes of the law it didn’t happen.

I'm not justifying Urban perhaps dropping the ball on Zach's October 2015 incident, but this is also around the time that JT Barrett was arrested for DUI and sequentially suspended for the Minnesota game. I can imagine Urban was drawn to JT's situation since it was the headline of the day. Just a theory though it certainly doesn't justify what happened.

As weird and disconnected all of this is, and because Shelly and Ms. Smith shared texts and Shelly was aware of the circumstances,  Urban is toast.  Sucks! But dude had a chance to go full disclosure and chose not to. Dude didn't break a law or violate a code..but he's toast!..
