but...

It specifically says for a clothing line, doesn't it? it's just a way for the university to have some control over something that has become associated with it. It's way more mundane that the headline (and the partial skim most people read articles with) makes it.

I was just talking about the April Fool's a couple years ago with the renaming of Ohio Stadium lol. Was it Safelite? I can't remember, but what I do remember is about 30 people losing their ever-loving minds over it before someone realized what was going on.

I do not hold this University in a very high esteem (nor many others), even though I went to school here.  The day the basketball and football teams cease to exist, is the day my ties to The University also cease to exist.  I consider the brand of tOSU athletics to belong to the people of the great State of Ohio, and not to a greedy Corporation.

All due respect to Mr. Gerben, legally speaking there's no reason why TOSU can't trademark "THE" as they have submitted to the USPTO. Again, Mr. Gerben's analysis is more akin to a copyright standard; to trademark something, your bar is significantly lower. You don't need sophisticated samples, you merely need to show a valid use of the mark in the flow of commerce, which, with the previous use of "THE" on T-shirts, decals, etc., meets this test.

So two caveats to my comment: (1) I've worked in TM law only on the litigation side, not the PTO, and (2) I haven't looked at the actual "mark" being submitted (i.e., design, color, etc.)

But...  while I don't disagree with anything you've said, for a TM to really be worth anything, it has to have some degree of distinctiveness in the context of the origin of goods/services.  "The" is probably the most generic of potential marks I can think of.  It's hard to imagine how "the," alone, is in any way distinctive or indicative of the origin of goods/services in a market full of other institutions, companies, etc. containing the word "the" in their names.

But, hey, I haven't read the filing.  Maybe they got super creative with it.  Maybe it's a specific font, color, etc.  Who knows.

Agreed. My primary reason for not donating is because I paid (and am still paying for) my tuition so I don't feel a particular need to give a few bucks to a state funded enterprise that has billions of $ in its war chest and frequently receives donations from extremely wealthy individuals.

Efforts like trademarking "The" just make that decision that much easier.

Grammatically speaking, using the definite article "the" before Ohio State University is repetitive and unnecessary.  Are you trying to differentiate this Ohio State University from all the other Ohio State Universities? There is only one Ohio State University.

Proper nouns refer to specific people, places, and things (Martin Luther King, New York City, St. Patrick’s Cathedral). However, even though these nouns are inherently definite, the definite article THE is not used with most SINGULAR proper nouns

Using "The" before Ohio State University would make sense if there was a group of Ohio State Universities that you were trying to distinguish it from. And before anyone starts throwing around Lima, Mansfield, etc., those are already unique because they have the location in their name. Now, if it was The State University "of" Ohio, or it was The Ohio State Universities (plural proper noun), use of the definite article would be appropriate.

In English, you use the article THE with proper nouns:

- to accompany PLURAL proper nouns, including the plural form of a family name:e.g.   THE Johnsons will go to court today.
The United States
The United Nations
- with proper nouns containing the word OF or a political word like ‘kingdom’, ‘union’, or ‘republic’, or organizational words like ‘institute’, ‘foundation’, or ‘corporation’.e.g. The city of New Orleans

Frankly, THE whole thing is silly. Maybe THE English Department should weight in on THE matter before THE attorneys take it to THE Supreme Court of THE United States.

AFAIK, the inception of using "THE" in front of tOSU started after the OSU v. Ohio U trademark issue... using "THE" was a way to differentiate OSU's trademark interests from Ohio U's trademark interests, with the limited exception of Script Ohio, and variants thereof.

I think it’s not pretentious because we don’t use it in an elitist way? We use it as a joke - it’s like a nickname. At least when you listen to our guys say it before NFL games it’s always with a sort of faux pretentious tone. Like it’s our inside joke that we use it because I think we all agree it’s stupid.  Also frankly there isn’t much to be pretentious about - we’re just a state school much like any other.

This is public relations disaster.  I don't know how many overpaid administrators it took to make this decision, but it makes you really question if any of them have an ounce of common sense.  Splitting legal hairs aside, it looks like something a middle school project team would have tried for.  The guy who is the university's spokesman who said that it is all about enhancing the teaching and research mission of the school should have his head examined.  Everyone knows this is a money grab to sell more gear to fools looking to part with their money.  The first idiot that walks around Lane Ave. on game day with a "THE" cap on will confirm the idiocy involved here.  

I am embarrassed to have my degree today.  I hope the Ohio State Football University comes to its senses.  Just say it was a joke or something.
