I’m not sure I’ve ever heard of a board not eventually approving something like this. The vote is a formality and all the terms have been discussed with them over email and such a million times already (I work at a F500 and we post drafts of stuff for our BOD all the time). 

But to answer your question Day would likely just keep working as normal on an interim basis until it WAS actually approved (though his agent might try to get come extra money for the hassle). Working without a contract isn’t the same as being fired.
