Fox Sports is reporting Will Smith had a high BAC the night of his murder, although the toxicology reports haven't been released yet.

This certainly will not help in the pursuit of justice.  Let's not forget, however, that whatever occurred with a slight fender bender, his killer apparently chased them down, intentionally crashed into the back of Will Smith's vehicle, then shot Raquel in the legs before shooting Will multiple times.  IMO, this is not dispositive of anything, although the defense will surely make hay.
