How does Emmert think this is not completely transpartent to anyone watching? The NCAA uses an attorney to get testimony from two individuals that they could not previously interview. I can't figure out any way that this can be viewed as illegal or even unethical.

I will have to eat crow here. What I did not realize is that the two men were interviewed under oath in a deposition. While not illegal, what the NCAA did here is certainly unethical and Un-American.
They essentially forced these men to answer questions about NCAA rules under penalty of perjury...as if NCAA thinks it is part of the US judiciary system. In fact, that same US judiciary system should be talking a pretty long look at what was done here.
This isn't going to end the way Buckeye fans want it to. Can't say i'm all that surprised.

Gotta love technicalities. Almost makes one wish Ohio State didn't cooperate as much as they did and try to make the NCAA work a bit harder. Not saying that would be the better idea because no one knows if Miami will get off any easier, but for the possibility that it could get thrown out it would have been cool for OSU to get off scott free.
I actually do hope that Miami gets away because I think it would further the demise of the NCAA and maybe introduce a new governing body to run things, hopefully more competently. You do want Miami to get what they deserve but anything that will show how truly corrupt the NCAA actually is would be awesome too.
I'm really torn on this one. I have a deep rooted hatred for the U and would like to see the entire program tied to a stake and set ablaze. However, the nephew is a redshirt sophomore on the team and had nothing to do with the violations. Maybe, the NCAA can continue to stall for two more years until he graduates.

I feel bad for your nephew bc of how long it takes tNCAA to make rulings on violations. It's not fair for the players to get punished for things that they didn't even participate in...very similar to PSU and OSU. tNCAA should start to implement other ways to punish who actually committed the violations. For instance...why give Tress a show cause...if you're going to punish the University and present players...??? Makes no sense...

I had a feeling something would happen to hinder the punishment of the U. I had no idea it would be this F'ed up though. This seems not only deliberate but almost like it's old news so why hold them accountable (at least this seems to be the case from NCAA stance as well as them screwing up the investigation and now they have to investigate themselves...just seems strange or perhaps not...may be they did it on purpose???).

Throwing my attorney hat on here (but admittedly having no experience with NCAA issues) and I do not believe this should have much impact on the investigation or sanctions that Miami will receive. It might, and it will certainly delay things as the NCAA attempts to save face and not upset its members, but I do not believe that it should have any other noticeable impact on the investigation or sanctions. This is not a criminal investigation of Miami and, if it were, I would feel differently.
The NCAA is a governing body for university athletics but it is not a governmental body. The NCAA does not have subpoena power and the way it got its information is not illegal as far as I know (the attorney may have some disciplinary issues that will arise from this though). As long as the information obtained is reliable and trustworthy in the NCAA's mind, I think it should be allowed to base its decision on that information. Miami agreed to that when it agreed to be part of, and governed by, the NCAA.
To the extent the two gentlemen at issue were forced to answer questions regarding the NCAA that they should not have had to answer, they could have protected themselves. If they hired counsel, and the questions were completely irrelevant to the issues in the bankruptcy case, their counsel could have objected and instructed them not to answer the questions.
Exactlly, I see no reason why they shouldn't use all available information. They didn't seem to care that Tressel's information came illegally (and this case it doesn't even appear to be illegal). I believe that attorney has had his bar membership either revoked or suspended as a result of what he told Tressel.
I third this...and yes, I belive the Columbus attorney was suspended from the BAR for 1 year.

The NCAA is setting up for possible "outs" and testing the waters before this goes public. They know they are toting a thin line and getting more ridiculous (post Penn State and all).
The big issue I have, and I'm sure many have, is just be consistent. It's the same as referees...I don't care if you're strict or loosey goosey, just be consistent with that so we can make our own judgements on how to act/behave. The is seemingly all over the map. I know there are many variable to every case but these guys are playing with fire.
