I'm sorry but that was funny.  Not really sure what the police would charge the guy with as he has a rock solid alibi placing him several hundred miles from any burning couches.  The cell service was non existent so I guess you arrest the Fox production crew because they communicated the message back to east Lansing.

They will charge him with inciting violence or anarchy, which is just a clever way for the cops and the powers that be to circumvent the First goddamn Amendment.  You would think the First one would get a little respect.

Above all else, he didn't commit a crime. Secondary, but still equally as important to the ELPD,...
he wasn't in their jurisdiction.

Grammar aside, I thought that was brilliant on their part, because everything that happens on Facebook is protected by the veil on anonymity... What ELPD genius decided to go this route in the first place? Good grief, Charlie Brown.

This is the reason I never scored very high on the verbal portion of the SAT and GRE. If you point them out, I can obviously tell they are wrong. Casually reading it, I would never catch these mistakes.

It's this murky "persuasive language" statute.  If he allegedly supports and persuades people to burn couches in East Lansing, he is breaking Michigan law.  but this case is just total BS.  There are too many mitigating factors, such as the fact that he had no idea whether or not that sign would appear on television.

That is really interesting, can you provide a link to the statute? Is it a state of Michigan statute or a Federal statute that allows a local police department to enforce an (apparent) state law??

It's federal law it's just some random crap that stuck with me from my Constitutional Law class.  I'm sure I have the wording wrong but there is definitely a law against it otherwise why would this thread even exist?

I think that was Bob, Brian's dad. And the government didn't make him apologize, his employer did. The First Amendment only prevents the government from restricting speech -- it doesn't prohibit an employer from telling its employees (esp. those who are broadcasters) what they can say and what they have to apologize for saying.

Indeed it was his employer that made him apologize.  However, I was attempting to point out (obviously not very well) that there is a pervasive thought of "we have freedom of speech, unless we say something somebody else doesn't like" in this country.  I think that kind of thinking defeats the purpose.

Then you don't understand the purpose of freedom of speech. 
It doesn't protect you from society (employers, friends, colleagues, family, etc) thinking an individual is a bigot, racist, all around jackass, etc.
You are free to say whatever you like and the government will respect that.

No they won't! Yeah you can say whatever but if you say any of the 4,000,000 keywords you get thrown on an FBI watchlist and they can build a case against you by linking together parking tickets or some BS.
1) make people fearful
2) make them angry and/or assign a broad scapegoat (terrorists)
3) Convince them that the less freedom they have the safer they are
4) slowly control them
It's a basic formula.

Whoa there.  If anybody in this country, employer or not, forces you to do something to keep your job because of something you said that is a technical violation of the First Amendment.  They can fire you outright for a reason like "not complying to the standards of the company", but when they make you verbally apologize on national television and basically blackmail you in order for you to remain employed...well that's just wrong.
